SAN FRANCISCO (press release)—Taxpayers have a new issue to be outraged about. In an almost surreal judgment, a San Francisco judge on Thursday ruled that an inmate convicted of murder will receive taxpayer-funded sex-change surgery that could cost $100,000. Reasoning? To not do so violates his/her constitutional rights.
The ruling from U.S. District Judge Jon Tigar “marks just the second time nationwide that a judge has issued an injunction directing a state prison system to provide the surgery,” according to the Associated Press.
This sets a precedent since the previous order, issued in Massachusetts in 2012, was overturned and is still being appealed to the U.S. Supreme Court. Meanwhile, California Corrections Health Care Services spokeswoman Joyce Hayhoe told the Los Angeles Times the operation will cost taxpayers in the neighborhood of $100,000 dollars. Why so high? The inmate must be guarded the entire time while being treated at a public hospital outside the prison.
The patient/inmate is “Michelle-Lael” Norsworthy, 51, who was born Jeffrey Bryan Norsworthy. He/she was convicted of second-degree murder in April 1987. He/she is currently serving 17 years to life at Mule Creek State Prison in California which is an all-male prison population.
Judge Tigar wrote in his ruling, referring to sex reassignment surgery, “The weight of the evidence demonstrates that for Norsworthy, the only adequate medical treatment for her gender dysphoria is SRS.” This is contrary to previous court filings where corrections officials argued that Norsworthy had received counseling, mental health treatment, and hormone therapy to treat the gender dysphoria.
The judge cited Norsworthy as a target for assault and rape in the all-male prison. This will now set the standard for hundreds of other prisoners throughout the U/S. prison system with similar medical issues. It should be noted that rape of straight men in all-male prisons happens frequently without anyone asking for a sex change operation.
